In Arkansas, evictions are handled through a legal process known as an Unlawful Detainer Action. This process allows landlords to regain possession of property when a tenant violates the lease or remains in possession without legal authority.
Before a lawsuit can be filed, Arkansas law requires the landlord to serve the tenant with proper notice. If the tenant fails to cure the breach or vacate, an unlawful detainer complaint may be filed.
Once served, the tenant may file an objection with the court stating their legal reason to remain in possession. If the tenant fails to file a timely objection or cannot demonstrate a legal right to remain, a writ of possession can be issued. The Sheriff serves the writ and typically allows approximately 24 hours for the tenant to remove their belongings before enforcement.
